1. Eligibility Restrictions

• Body Armor: Pursuant to 18 U.S.C. § 931, individuals convicted of a violent felony are prohibited from purchasing, owning, or possessing body armor, except with written employer permission for job-related use. By clicking “No, I’m Not a Felon” during checkout, you affirm that you are not a convicted felon, are at least 18 years of age, and are legally eligible to purchase body armor.
• All Products: You must be a U.S. citizen or permanent resident and at least 18 years old to purchase any product from Apex Outlander. You agree that you are purchasing these items for lawful personal use and not for resale, transfer, or use by ineligible persons.

2. Geographic Restrictions

• Body Armor:
• Connecticut: Online sales of body armor to non-law enforcement residents are prohibited under Public Act 98-127. Purchases must be made in-person at an authorized physical store. Apex Outlander will not ship body armor to Connecticut addresses, except to verified law enforcement entities.
• New York: Effective July 6, 2022, body armor purchases are restricted to individuals engaged in eligible professions (e.g., police officers, peace officers, military personnel) as defined by New York Executive Law § 144-a. Sales must be in-person with proof of eligibility. Apex Outlander will not ship body armor to New York addresses, except to verified eligible professionals. Unlawful purchase of body armor in New York is a Class A misdemeanor for the first offense and a Class E felony for subsequent offenses.
• All Products: Apex Outlander ships only within the contiguous United States, Alaska, Hawaii, and U.S. territories to addresses permitted by law. International shipping is strictly prohibited without a valid export license issued by the U.S. State Department under the International Traffic in Arms Regulations (ITAR).

3. Product-Specific Regulations

• Thermal Imaging and Night Vision Devices:
• These devices are legal for civilian ownership in most states but are subject to state-specific hunting regulations. For example:
• California: Prohibits active night vision devices (using infrared light) and their use with firearms for hunting. Thermal imaging is banned for hunting.
• New York: Prohibits night vision and thermal imaging devices for hunting deer and other game.
• Alaska, Arizona, Colorado: Ban thermal imaging for hunting.
• Buyers must consult their state’s wildlife agency to ensure compliance with hunting laws. Use of these devices for illegal surveillance (e.g., monitoring private property without consent) may violate federal and state privacy laws, including the Fourth Amendment as interpreted in Kyllo v. United States (2001).
• IR Weapon-Mounted Lasers:
• Regulated by the U.S. Food and Drug Administration (FDA) as Class IIIb or IEC Class 3B lasers. Civilian-legal Class 1 IR lasers may be purchased, but high-powered military-grade lasers are restricted to government and law enforcement. Buyers must comply with FDA regulations and state laws (e.g., California and Massachusetts restrict high-powered lasers; New Jersey prohibits laser sights during night hunting).
• Gas Masks: No federal or state restrictions apply to civilian ownership, but misuse (e.g., to evade law enforcement) may result in legal consequences.

4. Terms of Purchase

• You are not a person with a previous conviction of a violent felony.
• You will not ship or attempt to ship products to Connecticut, New York, or any international address without proper authorization.

• You assume all risks associated with the use of these products and will not hold Apex Outlander liable for misuse, injury, or legal consequences arising from improper use.

5. Export Restrictions

All products sold by Apex Outlander, including body armor, gas masks, thermal imaging devices, night vision devices, and IR lasers, may be subject to ITAR and/or Export Administration Regulations (EAR). Exporting these items outside the United States without a valid license from the U.S. State Department is strictly prohibited and may result in severe penalties.

6. Delivery and Liability

• Estimated delivery times are currently 6–8 weeks from the date of order confirmation. Delays may occur due to supply chain issues or compliance verification.
• Apex Outlander is not liable for any damages, injuries, or legal consequences resulting from the misuse, improper handling, or unlawful use of our products.
